Appeal by the defendant from a judgment of the Supreme Court, Queens County (Clabby, J.), rendered November 26, 1985, convicting him of criminal possession of a controlled substance in the third degree, criminal possession of a controlled substance in the fourth degree and criminally using drug paraphernalia in the second degree (two counts), after a non-jury trial, and imposing sentence. Ordered that the judgment is reversed, on the law, the indictment is dismissed as to the defendant, and the matter is remitted to the Supreme Court, Queens County, for the purpose of entering an order in its discretion pursuant to CPL 160.50. Issues of fact were not raised or considered.
